Constitution doesn’t allow everyone to do phone tapping: Supreme Court

A Constitution Bench of the Supreme Court on Wednesday remarked that the Constitution does not allow anyone to tap phones. A seven-member constitutional bench headed by Justice Aminuddin Khan held a hearing regarding the phone tapping. Justice Muhammad Ali Mazhar inquired whether there is any legislation related to phone tapping. “There is a law that deals with phone tapping,” the Additional Attorney General said. “Phone tapping has been in the constitution since 2013. Both the ISI and the IB are notified to tap the phones,” said the AAG. Justice Muhammad Ali Mazhar said phone tapping can only be authorized by the sitting judge. Notified a judge?The Additional Attorney General was not aware of the nomination of any judge in the phone tapping case.Justice Jamal Khan Mandukhel remarked that the law on phone tapping is quite vague. Justice Muhammad Ali Mazhar remarked that the law does not allow everyone to tap phones. Later, the Constitution Bench adjourned the hearing and issued notices to the Advocate Generals.
